WHEELMAX TERMS OF SERVICE

1. DEFINITIONS

To ensure clarity and consistency, the following terms shall have the meanings assigned below:

• Platform: The Wheelmax website, mobile applications, and all related services.
• User: Any individual or entity that accesses or uses the Platform.
• Seller/Dealer: A User who lists vehicles, parts, or services for sale.
• Buyer: A User who views, inquires about, or purchases listings.
• Listing: Any vehicle, product, or service posted on the Platform.
• Tokens: Digital credits used to access paid features on the Platform.
• Services: All features offered by Wheelmax, including listings, inspections, promotions, and related tools.

2. ELIGIBILITY

The Platform is intended only for individuals and entities capable of entering legally binding agreements. By using the Platform, you confirm that you meet these requirements:

• You must be at least 18 years old.
• You must have the legal capacity to enter into contracts.
• You must provide accurate, current, and complete information.

Wheelmax reserves the right to suspend or terminate access for users who do not meet these requirements or who provide false information.

3. ACCOUNT REGISTRATION

Certain features of the Platform require account registration. You are responsible for maintaining the integrity and security of your account.

• You must provide truthful and up-to-date registration details.
• You are responsible for safeguarding your login credentials.
• You are responsible for all activity conducted under your account.
• You must notify Wheelmax immediately of unauthorized access.
• Wheelmax may suspend or terminate accounts that violate these Terms or pose a security risk.

4. ROLE OF WHEELMAX

Wheelmax operates solely as a digital marketplace that connects Buyers and Sellers. It is important to understand the limits of our role:

• Wheelmax does not own, sell, or purchase vehicles or listed items.
• All transactions occur directly between Buyers and Sellers.
• Wheelmax does not guarantee the accuracy, quality, legality, or condition of listings.
• Wheelmax does not verify ownership or authenticity unless explicitly stated.
• Wheelmax is not responsible for disputes, fraud, or failed transactions between users.

Users are solely responsible for evaluating and engaging in transactions.

5. LISTINGS AND SELLER RESPONSIBILITIES

Sellers are responsible for ensuring that all Listings comply with applicable laws and accurately represent the items offered.

• Listings must be truthful, accurate, and not misleading.
• Sellers must have legal ownership or authorization to sell listed items.
• All required documentation must be valid and available upon request.

Wheelmax reserves the right to remove or edit listings at its discretion, reject non-compliant content, and suspend accounts involved in violations.

6. BUYER RESPONSIBILITIES

Buyers are expected to exercise due diligence when interacting with listings and sellers on the Platform.

• Buyers must independently verify listing details before making decisions.
• Buyers are responsible for inspecting vehicles or requesting inspections.
• Buyers must ensure compliance with applicable laws when completing transactions.

Wheelmax does not guarantee seller credibility, accuracy of descriptions, or successful completion of transactions. All decisions are at the Buyer's own risk.

7. PAYMENTS, FEES, AND TOKENS

Wheelmax may offer vehicle inspection services either directly or through third-party partners.

• Reports are based on observable conditions at the time of inspection.
• Reports are professional opinions, not guarantees or warranties.
• Inspections may not detect hidden or future defects.

Wheelmax is not liable for undetected faults, mechanical issues discovered after purchase, or outcomes based on these reports.

9. PROHIBITED CONDUCT

• Posting false, misleading, or fraudulent information.
• Circumventing platform systems to avoid fees.
• Engaging in harassment, abuse, or unlawful conduct.
• Uploading malicious software or harmful content.

Violations may result in immediate suspension, removal of content, or legal action.

10. INTELLECTUAL PROPERTY

• All Platform content is owned or licensed by Wheelmax.
• Users may not reproduce or exploit Platform content without permission.
• Users grant Wheelmax a worldwide license to use and display uploaded content.

11. PRIVACY AND DATA USE

Wheelmax collects and processes personal data in accordance with its Privacy Policy. By using the Platform, you consent to data collection and sharing with other users for transaction purposes, service providers, and legal authorities.

The Platform is provided on an “as is” and “as available” basis.

Wheelmax makes no warranties regarding availability, accuracy of listings, or transaction outcomes. Use of the Platform is at your own risk.

13. LIMITATION OF LIABILITY

Wheelmax shall not be liable for indirect, incidental, or consequential damages, loss of profits, or defects related to vehicles or services.

14. INDEMNIFICATION

You agree to indemnify Wheelmax from claims arising from your use of the Platform, violation of these Terms, or disputes with other users.

15. TERMINATION

Wheelmax reserves the right to suspend or terminate access for violations, remove listings without notice, and restrict access to protect the Platform.

16. DISPUTE RESOLUTION

• Disputes shall be governed by the laws of the Federal Republic of Nigeria.
• Parties may agree to mediation or arbitration before litigation.

17. MODIFICATIONS TO TERMS

Wheelmax may update these Terms at any time. Continued use constitutes acceptance of revised Terms. Material changes may be communicated directly.

18. SEVERABILITY

If any provision is found invalid, the remaining provisions shall remain in full force and effect.

19. ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and Wheelmax and supersede all prior agreements.
